Aerial Arts Backyard Rig Use

Please read this agreement carefully before using the aerial rig, straps, ropes, silks, hammocks, or related equipment.

Important Safety Notice

Aerial arts involve serious risk, including falls, equipment-related injuries, paralysis, and death. Do not participate unless you understand these risks, are physically able to participate, and voluntarily choose to do so.

Participant Agreement, Release, and Assumption of Risk

In consideration of being permitted to use or participate in activities involving the aerial rig, aerial straps, ropes, silks, hammocks, related apparatus, equipment, and surrounding premises located at 7623 N 17th Dr, Phoenix, Arizona, I hereby agree to release, indemnify, and discharge Brian Baze, Christopher Potter, 7623 N 17th Dr, their agents, officers, volunteers, guests, homeowners, property owners, employees, and all other persons or entities acting in any capacity on their behalf, hereinafter collectively referred to as the “Released Parties,” on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate, as follows:

1. I acknowledge that my participation in aerial arts, aerial straps, ropes, silks, hammocks, circus arts, conditioning, demonstrations, informal practice, and related activities involves known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity.

   The risks include, among other things: slips and falls; falls from height; falling from or onto equipment; improper mounting or dismounting; rope burns; fabric burns; pinches; scrapes; twists; jolts; entanglement; overexertion; dizziness; loss of grip; collision with the rig, ground, mats, apparatus, or other participants; equipment failure or misuse; weather, lighting, surface, or environmental conditions; injuries caused by other participants or persons present; and injuries caused by my own physical condition, fatigue, skill level, judgment, or decision-making.

   These risks may result in scratches, bruises, sprains, strains, lacerations, fractures, concussions, musculoskeletal injuries, head injuries, neck injuries, back injuries, spinal injuries, internal injuries, paralysis, death, emotional or psychological injury, or property damage.

2. I understand that this activity may take place during a private social event and may not be conducted as a formal class, professionally supervised training session, or controlled studio environment. I acknowledge that other guests may be present and that I am responsible for choosing whether, when, and how to participate.

3. I acknowledge that the Released Parties seek to promote safety but are not infallible. They may be unaware of my fitness, medical condition, ability, training history, experience level, fatigue, impairment, or limitations. They may give incomplete warnings or instructions, and the equipment, rigging, mats, apparatus, anchor points, or surrounding premises may malfunction, shift, fail, or otherwise contribute to injury.

4. I expressly agree and promise to accept and assume all risks existing in this activity, whether known or unknown, anticipated or unanticipated. My participation is purely voluntary, and I elect to participate despite the risks.

5. I certify that I am physically and mentally able to participate safely. I certify that I am not participating while impaired by alcohol, drugs, medication, fatigue, illness, injury, or any other condition that would affect my judgment, coordination, grip strength, balance, or ability to participate safely. If I choose to participate despite any such condition, I accept full responsibility for that decision.

6. I agree to inspect the equipment, apparatus, mats, rig, and surrounding area before participating. If I believe anything is unsafe, I agree not to participate and to notify the Released Parties.

7. I agree to follow all posted or verbal safety instructions. I agree not to use any apparatus or perform any movement, drop, inversion, climb, release, or skill beyond my training, ability, or comfort level. I understand that I am responsible for my own conduct and choices while using the equipment.

8. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the Released Parties from any and all claims, demands, or causes of action that are in any way connected with my participation in this activity, my presence on the premises, or my use of the equipment, rig, apparatus, mats, or facilities, including any such claims which allege negligent acts or omissions of the Released Parties.

9. Should the Released Parties or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

10. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

11. In the event that I file a lawsuit against any of the Released Parties, I agree to do so solely in the state of Arizona. I further agree that the substantive law of Arizona shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

12. I agree that this agreement applies to today’s participation and to any future participation in aerial arts, circus arts, conditioning, demonstrations, informal practice, or related activities involving the Released Parties, the premises, or the equipment, unless replaced by a later written agreement.
